Common San Jose Situations

We see these often. Each one has a guide with more detail.

You own an older apartment building

San Jose's Apartment Rent Ordinance covers buildings of three or more units built and occupied before September 7, 1979. We make offers on rentals, so bring your rent roll.

Selling a rental property

Your home took on water

The February 2017 Coyote Creek flood led 14,000 residents to evacuate, per SPUR. We often buy homes with past water damage as-is.

Selling a house that needs repairs

Your lot is on a hazard map

State seismic hazard zone maps cover parts of Santa Clara County, per the California Geological Survey. Your natural hazard report will show any zones for your parcel.

What to have ready for your first call

You are selling a higher-value home

San Jose's Measure E tax adds 0.75% to 1.5% on transfers above a set threshold. Check with your escrow officer for the current threshold.

What a net cash offer means

You inherited a family home

Under Prop 19, a parent's tax base generally carries over only if the home becomes the child's principal residence. We often buy inherited homes as-is.

Selling an inherited house

You missed mortgage payments

California owners can generally reinstate until five business days before the trustee sale date. Requesting an offer early leaves more time to weigh your options.

Selling a house in pre-foreclosure

Your listing did not sell

In September 2026, 28.5% of San Jose homes for sale had a price drop, per Redfin. A cash offer is another path you can consider.

Selling after your listing expired

The house is sitting empty

Already moved out? We often buy vacant homes as-is, and you can often pick a closing date that suits you.

California Rules Worth Knowing

The basics for selling a home in Santa Clara County. General information, not legal or tax advice.

Transfer taxes in San Jose

Santa Clara County may charge $0.55 per $500 under Revenue and Taxation Code 11911. San Jose Municipal Code 4.58 adds a city conveyance tax of $1.65 per $500.

Measure E on larger sales

San Jose Municipal Code 4.59 taxes transfers above a threshold at 0.75%, 1% or 1.5% of the full price. The threshold started at $2 million and adjusts for inflation every five years.

Disclosure statement and hazard report

Civil Code 1102 calls for a Transfer Disclosure Statement on most home sales. Civil Code 1103 covers flood, fire, fault and seismic hazard zones. Neither can be waived.

Notice before a trustee sale

Civil Code 2924f says the notice of sale is posted and recorded at least 20 days ahead. It is also published once a week for three weeks.

San Jose Seller Questions

Straight answers on how a cash sale works here.

Who makes the offer on my house?

We do. Cash Offer Company buys houses in Santa Clara County. Requesting an offer is free and there's no obligation.

Does Measure E apply to my San Jose sale?

Only for property inside San Jose city limits that sells above the Measure E threshold. The threshold adjusts every five years, so check with your escrow officer for the current threshold.

Can I sell a building under the Apartment Rent Ordinance?

Often, yes. We make offers on rentals, and we may buy rentals with tenants in place. Ask an attorney about tenant rules before giving any notice.

My home flooded in the past. Will you still make an offer?

In many cases, yes. Tell us what happened, what was repaired and any insurance claims. We often buy San Jose homes with past water damage as-is.

Do I need to fix anything before I sell?

Usually not. We often buy homes as-is, so you can skip repairs, staging and showings in many cases.

What disclosures do I give in an as-is sale?

Usually a Transfer Disclosure Statement and a natural hazard report. Civil Code 1102.2 exempts some transfers, such as certain probate and trust sales. An attorney can confirm what applies.

Do you buy outside San Jose?

Yes. We buy across Santa Clara County, including Sunnyvale, Santa Clara, Milpitas, Campbell, Cupertino, Morgan Hill and Gilroy.

How fast can I close?

It depends on escrow and title work. Many cash sales close sooner than a financed sale, and you can often choose a date that fits your move.
